How DWP Deals With Complaints
DWP aims to resolve complaints within 15 working days, but says it is receiving a high number of complaints, so it may take longer. You get a final response from the DWP complaints team by phone or letter. Keep it, because the Independent Case Examiner will ask for a copy.
If your complaint is about a company that provides a service for DWP, DWP says it will not investigate it. Contact the company directly.
The Independent Case Examiner
The Independent Case Examiner only looks at a complaint once DWP's complaints process is finished, so wait for DWP's final response first. It normally needs to hear from you within 6 months of that response, and says it will tell you within 2 weeks whether it can accept your complaint.
It looks at problems such as delays, poor service and procedures not being followed. It cannot look at whether a benefit decision was right, discrimination under the Equality Act 2010, government policy, or matters that are or have been the subject of legal proceedings.
Disagreeing With a Benefit Decision
A complaint is about how DWP treated you. If you think a decision about your benefit is wrong, ask for a mandatory reconsideration instead. It usually needs to arrive within one month of the date on your decision letter, and the contact details are on that letter.
